If you have significant costs you might try a lawyer specializing in motorcycle accidents. I think the AMA has a free referral system, and I am pretty sure Tom McGrath in Virginia can give a good referral (talk to several before signing, avoid any that insist you must sign on right away.)
How is your own insurance handling it? Has the driver admitted blame for that part of the process?
Hoping for a successful surgery and a quick recovery!

I haven't talked to her again. She was taking fault for it at the time but with no citation. She can say what she wants now. Her insurance co will too.
We have a motorcycle lawyer here ill try. But the ambulance chasers don't think its a good case without a citation(maybe cause you cant sue the crap ou of her for much wihout a citation) I dont know.
Well at this point I just need to fix myself. I've got good health insurance, and after a good look at the bike It didn't look like much more than plastic and paint.

Sure sounds like Barney Fyfe dropped the ball on this one. I would think there is fault regardless of stopping or not. You had the right of way.

Ticket or not, if she hit you and inflicted damage, she's liable.
Hope your foot surgery goes well, you'll probably wind with some pins to line things up and help the foot heal as good as new. _________________ '93 K1100LT

Yes Audi
Take care of that foot and may the surgery go nicely
If she admitted liability to you at the time, that may be enough.
Maybe write out a statement while you are in hospital and access any witnesses and have it signed by justice of the peace.
In Oz they normally ticket both parties just to make sure...but then you still have to do the footwork
Keep that foot elevated until the initial healing is over.... then comes the physio and then the walking to strengthen....
All good to you Mate
Stay calm |

Thanks for all the good thoughts.
Well, went back to doc after all he swelling went down. And the bones have lined back up and soft tissue is in good shape. He feels like we would be doing more harm cutting it open at this point, "I'm not gonna argue with that". There is still a chance they have to work on it, but for now. I'm just healing.
All in all I have 5 broken bones in my foot. The 3 middle meditarcles 1 knuckle and my middle toe!
I went through the intersection a few days ago. As it was no fault of my own, I think its important to remember that there is no room for complacency or some place less dangerous than another. This was a relatively slow speed crash that could of cost me a fOot and is a huge burden.
I think all the good energy is helping me heal. You guys rock!

Audi, I am so glad you have made it through, so far, without surgery and seemingly, without bitterness
Indeed it has been a sobering brush with calamity which you will never forget, and it looks like you may have lost your goodly K
I am grateful to you for sharing and reaching out for good energy and staying sane with a serious shock, especially as it looks, on the surface, as though you came off second best insurance-wise.
Please keep us posted of your road to full mobility and fitness.
Any pics are a bonus of course
All the very best

went to the doctor today. so far my foot is on the right track. the bones are healing and i can start to move my foot. doc doesnt think the bones will impede my recovery, however thier is no way to know the long term nerve damage, which is the real issue. all in all optimistic.
im still a little skittish while in a car, like someones going to hit me. bizarr side effect of being t boned i guess...
be safe fellas, drive like those cage f--kers are out to get us.......
3 more weeks with no weight on my foot. HMIV is looking real possible by bike.

Indeed they are and, in the main, they don't even know it; they're oblivious.

I just had another Drivers Ed class today, what you said is something I drill into they're heads many times.
"look out for cycles, just cause the calendar says February doesn't mean we aren't out on the road."
I even road to the class today. Some thought I was crazy.
Glad to hear your mending well. Listen to the therapists when you start rehab. _________________ Ride safe.
